1. Who we are
These Terms apply to the website builtbyotte.com and to everything you buy or download there. The website and store are run by BuiltByOtte, Gouden Boers 16, 8607 KE Sneek, the Netherlands ("BuiltByOtte", "we", "us").

By creating an account or placing an order you agree to these Terms. Please read them before you buy.
2. Who can buy
You must be at least 16 years old to create an account or buy. If you are under 18, you need permission from a parent or guardian. You buy either as a consumer or on behalf of a business; where the law gives consumers extra rights, those rights always apply.
3. Your account
You don't need an account before you buy: when you pay, the purchase is added to the account with the e-mail address you pay with, and that account is created if you don't have one yet. Your purchases, downloads and updates are kept there. You can log in with a password or with a login link we send to your e-mail address.
- Use an e-mail address you control; it is how you log in and how we reach you.
- Keep your password and login links to yourself. You are responsible for what happens in your account.
- We may suspend an account that is used for fraud, license abuse or a breach of these Terms. Where possible we tell you first and explain why.
4. Buying and paying
Prices are shown in US dollars or euros. BuiltByOtte uses the Dutch small business scheme (kleineondernemersregeling), so no VAT is charged: the price shown at checkout is the total you pay. Sales and coupon codes apply as shown in your cart; one coupon code can be used per order.
Payments are processed by Stripe. We never see or store your card details. Your order is placed when your payment is confirmed; you then receive a confirmation e-mail with a receipt.
Some of our resources are also sold on BuiltByBit and sourceXchange. If you buy there, that marketplace's own terms and refund rules apply to that purchase instead of sections 4 to 8.
5. Delivery and updates
Resources are digital and delivered straight away: as soon as your payment is confirmed, the download is available in your dashboard. Some payment methods take a little longer to confirm; delivery follows as soon as they do.
New versions of a resource you bought appear in your dashboard when we release them, at no extra cost, for as long as we offer that resource. We aim to keep resources compatible with current versions of the software they extend, but we cannot guarantee compatibility with every future release of third-party software such as Paymenter or Pterodactyl.
6. Your license
When you buy a resource you receive a license to use it, not ownership of the software. Unless the product page says otherwise, the license is:
- non-exclusive and non-transferable;
- for use on installations you or your business operate, including for your own customers;
- not a right to resell, share, publish or redistribute the files, in original or modified form.
Each download is prepared for your account and contains identifiers that link the files to your license. Removing them, or bypassing license checks, is not allowed. If a license is abused we may revoke it; if a payment is refunded or reversed, the license for that order ends.
7. Right of withdrawal
Consumers in the EU normally have 14 days to cancel an online purchase. For digital content that is not delivered on a physical medium, this right ends once delivery has started, provided you agreed to immediate delivery and acknowledged that you lose the right of withdrawal.
At checkout we ask for that consent with a checkbox. When you tick it, the download is made available straight away and the 14-day right of withdrawal no longer applies. We confirm your consent in the order e-mail. If you do not want to give up this right, do not complete the purchase.
8. Faults and refunds
A resource must work as described on its product page. If it doesn't, contact us at contact@builtbyotte.com or on Discord with your order reference and what goes wrong. We will first try to fix it. If we can't fix it within a reasonable time, you are entitled to a refund.
Apart from that, and apart from cases where the law requires otherwise, purchases are not refundable after delivery. Refunds go back to the original payment method through Stripe; the license for a refunded order is revoked and its downloads are no longer available in your dashboard.
If you dispute a payment with your bank instead of contacting us, we may suspend the license while the dispute is open.
9. Intellectual property
All software, documentation, logos, images and text on builtbyotte.com belong to BuiltByOtte or its licensors. You may not copy, modify for redistribution, or publish them without written permission, except as your license allows.
10. Acceptable use
You agree not to use the website or our resources for illegal or harmful purposes, not to bypass or tamper with license or security measures, not to share or resell our software without permission, and not to interfere with the website or other users.
11. Availability
We work to keep the website, dashboard and downloads available, but cannot promise uninterrupted access. We may pause the website for maintenance, updates or security. Our service levels are described in our SLA.
12. Liability
We are not liable for indirect or consequential damage, such as lost profit, lost data or downtime of your own systems, and our total liability for a purchase is limited to the amount you paid for it. Always keep backups before installing or updating software.
These limits do not apply to damage caused by our intent or gross negligence, and they never take away rights that consumer law gives you.
13. Ending your account
You can ask us to close your account at any time by e-mailing contact@builtbyotte.com; your licenses and downloads end with it. We may end or suspend an account or license for serious or repeated breaches of these Terms, fraud, or when required by law.
14. Privacy
We process your personal data as described in our Privacy Policy.
15. Changes to these Terms
We may update these Terms. The current version is always at builtbyotte.com/terms, and a purchase is governed by the version that applied when you placed the order. We tell account holders about important changes before they take effect.
16. Law and disputes
Dutch law applies. If you are a consumer living elsewhere in the EU, you keep the protection of the mandatory consumer rules of your own country. Please contact us first so we can try to solve the issue together; if that doesn't work, disputes go to the competent court in the Netherlands or, for consumers, the court the law assigns.
